REGOLAMENTO “&Co.MMUNITY Season 2”

“&Co.MMUNITY SEASON 2” RULES

 

1. PROMOTER AND PROGRAMME

Dedimax S.r.l. with registered office at Via Marino Mazzacurati 6, 42122, Reggio Emilia, Italy (hereinafter the "Company") is the promoter of the Initiative called "&Co.MMUNITY Season 2", a loyalty programme of MAX&Co. (hereinafter the "Initiative") that allows each purchase to accrue points (hereinafter "Dots") on a dedicated card (hereinafter the " "&Co.mmunity Card"), which, upon achievement of various goals (hereinafter "Status"), will give the Customer access to benefits and services (hereinafter "Rewards").

 

2. TERRITORIAL SCOPE

You can sign-up for the Initiative, activate the &Co.mmunity Card, accrue Dots on the card, and redeem for Rewards upon reaching the Status tiers at the it.maxandco.com online store and at participating physical stores operated under the MAX&Co. brand. The list of participating shops is available at the following link: it.maxandco.com/store-locator, selecting the filter “&Co.mmunity season 2”.  In addition to the shops of the MAX&Co. direct distribution channel (hereinafter "Direct Stores"), other physical shops bearing the MAX&Co. brand managed by third parties with a sales commission (hereinafter "Indirect Stores") will also be included among the shops participating in the Initiative.

 

The &Co.mmunity Card and related Rewards can only be used in Italy.

 

3. ELIGIBILITY AND PARTICIPATION

Only natural persons of adult age (hereinafter “Customer”) are eligible to participate in the Initiative.

Each customer is entitled to only one &Co.mmunity Card.

Customers may not use the &Co.mmunity Card for publicity or advertising purposes, except where expressly authorised by the Company in writing.

Customers signing up for the Initiative agree to provide accurate and true personal information. Using fictitious or another person’s identifying information is prohibited.

Customers are asked to keep their identifying and contact data up to date. This can be done by signing up or logging in to the "My Account" section of the website it.maxandco.com, via our Customer Service (contacts here it.maxandco.com/info/customer-care/contact-us), or with the assistance of the sales staff at any participating store.

At the Company’s discretion, terms and conditions of the Initiative may be changed and/or cancelled at any time with adequate notice.

Registration by the Customer in the Initiative implies the Customer’s unconditional and full acceptance of the terms and conditions contained in these Rules without limitation.

 

4. DURATION

The Initiative is valid from 6 March 2024 until 30 September 2026.

More specifically:

● Dot accrual period: from 6 March 2024 until 23 August 2026.

● Reward redemption period: from 6 March 2024 until 30 September 2026.

 

5. &CO.MMUNITY CARD

The &Co.mmunity Card remains the property of the Company; as a Customer, you are only the custodian of the card.

The &Co.mmunity Card is free of charge.

The &Co.mmunity Card is personal and non-transferable. Customers may be asked to show the &Co.mmunity Card at the time of purchase. The Company reserves the right to ask Customers for an ID document for proof of identity.

The Dots accrued on the &Co.mmunity Card may not be transferred to another Customer.

Customers signing up for the Initiative agree to the processing of their personal data and to be contacted (e.g. by regular mail, email, text message, multimedia message, telephone, and other digital means of communication) for information concerning the &Co.mmunity Card and/or notifications about the Rewards to which they have become entitled (as set out under item 8) and methods to redeem them.

Without prejudice to other rights under law, including the right to compensation for damages, the Company may withdraw a Customer’s right to use the &Co.mmunity Card and/or suspend its use and/or cancel registration in the Initiative in case of breach of the Terms and Conditions of Sale (at the link: it.maxandco.com/info/company-info/terms-and-conditions) and these Rules and Regulations or in case of misuse detrimental to the MAX&Co.brand and its image

 

6. ISSUANCE

The &Co.mmunity Card can be obtained as follows:

● At participating stores, by requesting the card from a member of the sales staff.

● At the online store it.maxandco.com (My Account registration required).

 

7. ADVANTAGES

&Co.mmunity Card holders will be entitled to:

● Participate in the Initiative.

● Obtain Rewards upon reaching the Status tiers, as described in item 8.

 

8. DOT COLLECTION AND REMOVAL

Purchases of any product at participating shops, remotely ("Remote Sales") and from the online store it.maxandco.com generate Dots. Dots are collected as follows:

● 1 Dot Point corresponds to €1.00 spent on products at full price or on sale, purchased in a store, via Remote Sales or from the online store it.maxandco.com.

● 1 Dot Point corresponds to €1.00 spent for the issuance of a Gift Card (e.g. the purchase and therefore the issuance of a Gift Card worth €50 will accrue 50 Dots). Conversely the use of Gift Cards will not accrue Dots (e.g. a purchase of €100 paid half with a €50 Gift Card and half with another form of payment will accrue only 50 Dots).

 

Note that:

● To accrue Dots from online purchases at it.maxandco.com you must be logged in to your My Account. Purchases made as an anonymous user do not earn Dots.

● To accrue Dots for purchases at participating stores, you may be asked to present your &Co.mmunity Card and an ID before each purchase.

● The Company may cancel and/or revoke wrongfully accrued Dots, earned by mistake, unlawfully and/or by violation of the Rules and Regulations.

● The Company reserves the right to change and/or cancel the Rewards during the validity period of the Initiative, giving the Customer reasonable notice.

● For purchases made from the online store at it.maxandco.com, the Dots will be added to the current balance at the end of the period allowed for exercising the right of withdrawal. Until that date, the Dots will remain temporarily frozen. In the event of a return within the withdrawal period, the temporarily frozen Dots will not be added to the current balance. If for some exceptional reason a request for the return of a purchase made from the online store it.maxandco.com is accepted after the withdrawal period, the corresponding Dots will be deducted from the current balance.

● For purchases made in Direct Stores or Indirect Stores, the Dots will be immediately added. In the case of a return due to product defect, if the Customer requests a cash refund (as required by European law), the return will result in an immediate removal of the corresponding Dots from the current balance.

● For purchases made via Remote Sales, the Dots are added to the current balance only when the purchase is finalized and not at the time of pre-authorization. In the event of a return within the withdrawal period, the same provisions apply for purchases made from the online store at it.maxandco.com.

● Purchases made using the Gift Card do not generate Dots.

 

You can check your Dot balance any time in one of the following ways:

● At participating stores, with the assistance of the sales staff.

● On the it.maxandco.com website in the “MY &Co.MMUNITY CARD” section of “My Account”.

● by contacting Customer Service.

 

Status tiers:

● “Peach” from 0 to 249 Dots.

● “Pink” from 250 Dots to 799 Dots.

● “Purple” from 800 Dots to 2,999 Dots.

● “Red” from 3,000 Dots to 7,999 Dots.

● “VIP” over 8,000 Dots.

This discount, which the Customer receives by email, is issued only once a year on the Customer's birthday, with a discount percentage corresponding to the Status that the Customer will have reached on that date and that can be used by the Customer from the moment of receipt within 30 days, only on products that are not on sale and with the exception of permanent items (and not for the purchase of Gift Cards).

This discount, which the Customer receives by email, is issued once within 180 days of achieving the Status and will be disbursed twice a year, specifically once in the six months from January to June and once in the six months from July to December. The discount provided to the Customer corresponds to the Status that the Customer will have reached upon activation of the Reward Promo and can be used by the Customer from the moment of receipt within a period of time specified by the Company, only on products that are not on sale and with the exception of permanent items (and not for the purchase of Gift Cards). For example: a Customer who earns Pink Status in January and Purple Status in February will receive the Purple Promo when it is next activated, no later than 180 days after earning Purple Status. If a Pink Promo is activated in the period between earning Purple Status and the activation of the Purple Promo, it will only be sent to Customers with Pink Status at the time the Pink Promo Reward is activated and not to those with a subsequent Status.

The discount can be spent in Direct and Indirect Stores and in the online store at it.maxandco.com and via Remote Sales.

&Co.mmunity Gift Card

The &Co.mmunity Gift Card that the Customer receives by email at the email address provided during registration for the Initiative is recognised only once when each Status is reached, and is issued in the month following the month in which the Status is reached (e.g. if the Customer reaches Pink Status in November, the &Co.mmunity Gift Card will be issued and sent to the Customer within the month of December). If the Customer achieves more than one Status change in the same month, they will be entitled to an &Co.mmunity Gift Card of a value corresponding to the sum of the & Co.mmunity Gift Cards for the Statuses achieved (e.g. if the Customer achieves the Status change from Peach to Pink on the 1st of the month and from Pink to Purple on the 15th of the same month, they will be entitled to an &Co.mmunity Gift Card having a value of €75, the sum of the two Status changes within one month). The maximum value of the &Co.mmunity Gift Cards that will be issued to the Customer is €175.00, a value that, as stated above, may be sent in a lump sum or in multiple parts, but which may not be exceeded for any reason.

My PINK Gift

The My PINK Gift is given once during the Initiative, when at least Pink Status is attained. The Customer will receive an email at the email address provided during registration for the Initiative containing instructions on how to receive the prize within six months of achieving the aforementioned Status. The indicative value of the gift is €5.00.

My PURPLE Gift

MAX&Co. Bottle

The My PURPLE Gift is given once during the Initiative, when at least Purple Status is attained. The Customer will receive an email at the email address provided during registration for the Initiative containing instructions on how to receive the prize within six months of achieving the aforementioned Status. The indicative value of the gift is €8.00.

My RED Gift

MAX&Co. Wallet

The My RED Gift is given once during the Initiative, when at least Red Status is attained. The Customer will receive an email at the email address provided during registration for the Initiative containing instructions on how to receive the prize within six months of achieving the aforementioned Status. The indicative value of the gift is €37.00.

My VIP Gift

MAX&Co. Runaway

The My VIP Gift is given once during the Initiative, when at least VIP Status is attained. The Customer will receive an email at the email address provided during registration for the Initiative containing instructions on how to receive the prize within six months of achieving the aforementioned Status. The indicative value of the gift is €168.00.

My VIP Permanent

Upon reaching VIP Status and until 30 days after the end of the Initiative, the Customer may take advantage of a permanent 10% discount on any purchase made in stores participating in the Initiative and from the online store it.maxandco.com. The discount granted to the Customer will be communicated by email by the Company and can only be used by the Customer on products that are not on sale and with the exception of permanent items (and not for the purchase of Gift Cards).

My Private Sales

My VIP Sales is awarded once per half year in June and December to the Customer who has attained at least Purple Status.

The corresponding discount is estimated at 25% and can be used by the Customer within a period of time communicated by the Company, for the purchase of all products of the Spring/Summer season in June and of the Fall/Winter season in December with the exception of permanent items (and not for the purchase of Gift Cards).

 

 

8A) BONUS DISCOUNT

From 06/03/2024 to 10/03/2024, the customer will receive a 15% discount to use between 06/03/2024 and 10/03/2024 after subscribing to the new “&Co.MMUNITY Season 2” loyalty programme.
Please note that the discount applies to all Spring-Summer 24 collection items except the following products:

8B) BONUS DOTS

From 11/03/2024 to 17/03/2024, when making at least one purchase, the customer will receive a bonus of 200 Dots in addition to the Dots earned based on the purchase made.
The bonus Dots will be accredited by 31/03/2024.
 
 

8C) BONUS DOTS

From 18/03/2024 to 24/03/2024, when making at least one purchase, the customer will receive a bonus of 100 Dots in addition to the Dots earned based on the purchase made.
The bonus Dots will be accredited by 31/03/2024.

 

8D) DOUBLE DOTS

From 12/04/2024 to 26/04/2024, Customers will receive double the Dots (2 Dots for every €1.00 spent) when they purchase one or more of the following products from the ELHAM Capsule line:

Cheetadream, Delicategold, Dreamtee, Dreamyland, Fallingold, Goldfall, Goldlion, Landscapelove, Springblossom and Wildlion.

Double dots will be credited between 12/05/2024 and 27/05/2024.

 

8E) DOUBLE DOTS

From 29/05/2024 to 16/06/2024, customers will receive double the Dots (2 Dots for every €1.00 spent) when they purchase one or more of the following products from the BLABLABLA Capsule by Pietro Terzini line:

&Cotee, Allovertext, Art&Memories, Blablaoffice, Boxyclaim, Excusemyback, Handycandies, Hugtime, Longveryshort, Midnight, Moodyhoodie, Ninety, Outofoffice, Sowindy, Squared, Stealbag&Heart, Toucheyes, Waterit.

Double dots will be credited between 02/07/2024 and 17/07/2024. 

 

8F) DOUBLE DOTS

From 13/09/2024 to 27/09/2024, Customers will receive double the Dots (2 Dots for every €1.00 spent) when they purchase one or more of the following products from the MAi Capsule by Richard Quinn line:

Anna, Aretha, Astrid, Brenda, Brigitte, Dalida, Doris, Glenda, Janis, Jo, Joan, Lena, Lena1, Madga, Maggie, Mina, Nancy, Nico, Raquel, Scilla, Sharon, Virna and Wilma.

Double dots will be credited between 13/10/2024 and 27/10/2024.

 

8G) DOUBLE DOTS

From 22/11/2024 to 13/12/2024, by purchasing one or more of the following products from the MAD LOVE Capsule line, inspired by the iconic DC characters The Joker and Harley Quinn, the customer will receive double the Dots (2 Dots for every €1.00 spent):

Cards, Graffity, Grin, Hahaah, Joke, King, Lovers, Madlove, Puddin, Punkie, Queen, Smiling, Spry and Teewb.

Double dots will be credited between 28/12/2024 and 11/01/2025.

 

8H) INTRODUCE A FRIEND

From 11/12/2024 to 30/06/2025, all customers already registered for the promotion will receive, via a personalised email, a link to share with their friends, with which they can register for the promotion. Customers will receive a 15% discount voucher if at least one of their friends registers for the promotion via the link received. Friends who register will then receive a 10% discount voucher only if they have agreed to receive marketing communications from the company.

Note that new customers will receive the personalised email, with the link to share with their friends, 40-45 days after registering for the promotion.

 

8I) DOUBLE DOTS

From 04/03/2025 to 18/03/2025, Customers will receive double the Dots (2 Dots for every €1.00 spent) when they purchase one or more of the following products from the Found Family Capsule line:

Astoria, Brighton, Broadway, Brooklyn, Canarsie, Chelsea, Columbuscircle, Coneyisland, Doyerstreet, Dumbo, Dykerheights, Fifthavenue, Foresthill, Greenpoint, Greenwich, Harlem, Jamaica, Lenoxhill, Longisland, Manhattan, Midtown, Nycity, Parkavenue, Soho, Solebag, Statenisland, Tribeca, Uppereastside, Westvillage and Williamsburg.

Double dots will be credited between 01/04/2025 and 15/04/2025.

 

8L) INTRODUCE A FRIEND 

From 01/08/2025 to 30/06/2026, all customers already registered for the promotion will receive, via a personalised email, a link to share with their friends, with which they can register for the promotion. Customers will receive a 15% discount voucher if at least one of their friends registers for the promotion via the link received. Friends who register will then receive a 10% discount voucher only if they have agreed to receive marketing communications from the company. 

Note that new customers will receive the personalised email, with the link to share with their friends, 40-45 days after registering for the promotion.

 

Note none of the discounts of this promotion can be combined.

 

8M) DOUBLE DOTS

From 08/09/2025 to 22/09/2025, Customers will receive double the Dots (2 Dots for every €1.00 spent) when they purchase one or more of the following products from the HERE WE GO AGAIN Capsule line:

Baddietee, Checkit, Cloudy, Denimbottom, Denimtop, Email&Drink, Furry, Goodvibesagain, Greatideas, Heartbreaker, Itshirt, Leaguetee, One, Ontherock, Oxford, Rainy, Relaxingdays, Sheisa10, Smarthome, Smartoday, Smelly, Stayhome, Stripedshorts, Warmy and Work.

Double Dots will be credited between 07/10/2025 and 21/10/2025.

 

Note none of the discounts of this promotion can be combined.

 

9. LOST, STOLEN OR DAMAGED CARD

In the event of a lost, stolen, or damaged &Co.mmunity Card, Customers can obtain a replacement card by visiting a participating MAX&Co. store and asking the sales staff for assistance or by requesting a new replacement &Co.mmunity Card at the website it.maxandco.com under “My Account” and the cancellation of the lost and/or damaged &Co.mmunity Card. The Rewards acquired by the Customer up to that point will not be affected by the replacement.

The Company is not liable for unauthorised use of the lost or stolen &Co.mmunity Card by a third party.

 

10. ENDING PARTICIPATION

Participation in the Initiative will end in the following cases:

● Upon the Customer’s request, at any time.

● At the end of the Initiative.

 

11. SURETY BOND

Surety bond no.000-2500-59360 for an amount equivalent to 20% of the estimated amount of the rewards expected to be redeemed (estimated value of €285,000.00) has been issued in favour of the Ministry for Business and Made in Italy, as provided for under article 7 of Italian Presidential Decree (D.P.R.) no. 430 of 26 October 2011.    

 

12. MISCELLANEOUS

The Company reserves the right to add other promotional initiatives during the Initiative, such as extensions of the Initiative or other Rewards that may be earned in addition to those already envisaged. The Company may revoke or change the method of execution of the Initiative for just cause, pursuant to Article 10 of Italian Presidential Decree 430/2001, giving prior notice to Customers in the same form used for the promotion of the Initiative or in an equivalent form.

The Company reserves the right to perform all checks relating to Customers’ proper participation in the Initiative. In the event of proven impropriety/illegality in Customers’ participation in the Initiative, the Dots accrued and Rewards earned shall not be recognised.

If the Rewards envisaged are no longer available due to force majeure, the Company reserves the right to provide a replacement Reward of equivalent or higher value, giving prior notice to Customers through the same channels used to promote the Initiative.

 

13. PRIVACY NOTICE

The Data Controller is Dedimax S.r.l. with registered office in via Marino Mazzacurati 6, 42122, Reggio Emilia, Italy. Dedimax S.r.l. hereby provides you with relevant information on how and for what purposes it processes your personal data, in accordance with article 13 of Regulation (EU) 2016/679.

Dedimax S.r.l. processes personal data collected in both hard copy (paper) and digital form in order to manage applications from Customers to join the &Co.mmunity Season 2 loyalty programme.

The data collected by Dedimax S.r.l. will be processed using electronic instruments for the most part, and only for the following purposes:

● To issue the &Co.mmunity Card.

● To manage the accrual of Dots earned through purchases.

● To manage the available Rewards based on earned Dots and the relative communications to the Customer, e.g. sending &Co.mmunity Gift Cards.

● Where applicable, to comply with any legal obligations that Dedimax S.r.l. may have as Data Controller.

Failure to provide the required personal data (marked with an asterisk) would result in Dedimax S.r.l. being unable to provide the service requested and for this reason the Customer will not be able to join the &Co.mmunity Season 2 loyalty programme.

Personal data may be handled by appointed employees or collaborators of Dedimax S.r.l. in charge of processing and by third party companies that after careful selection it may decide to appoint as data processors, as per article 28 of Regulation (EU) 2016/679, in order to provide Dedimax S.r.l. with processing services or activities related to the management of the &Co.mmunity Season 2 loyalty programme. These may include companies of the Max Mara Group providing technical-computer support for management of the &Co.mmunity Season 2 programme as well as affiliated companies and distributors involved in management operations pertaining to the &Co.mmunity Card, Dot accrual and the Rewards you choose to redeem. Where necessary in order to use the Rewards, the data may be disclosed to third parties for the provision of their services.

Personal data will not be transferred outside the European Union and will be stored by Dedimax S.r.l. for the period of time required under current legislation, adopting methods that ensure appropriate security levels. Once there is no longer a need to process the personal data, the data will be securely deleted from the systems, devices and media in which they are saved and/or archived.

Your personal data will not be disseminated.

Customers can at any time access their personal data, have it updated, rectified or erased, or exercise any other data rights under the current legislation on personal data protection by sending an email to infoprivacy@maxandco.com or by sending a letter by regular mail service to the address below: Dedimax S.r.l. with registered office in via Marino Mazzacurati 6, 42122, Reggio Emilia, Italy.

Customers can exercise the following rights by contacting Dedimax S.r.l. in any one of the ways described above:

● To obtain confirmation as to whether or not their personal data is being processed and to see that data.

● To update, change and/or rectify their personal data.

● To ask for their personal data to be deleted, made anonymous, or blocked if unlawfully processed, or for the processing of their data to be restricted.

● To object to the processing for legitimate reasons.

● To object to their data being used for sending advertising or direct marketing material, conducting market research or for commercial purposes.

● To withdraw their consent, where provided, which will not affect the lawfulness of the processing prior to the withdrawal of consent.

● To request the portability of the personal data they provided to the Data Controller (receive a copy of the data provided and ask to transmit that data to another Data Controller) or to file a complaint with a control authority.

The Data Controller has appointed a Data Protection Officer ("DPO”), who can be contacted by email at dpo@mmfg.it for information on data processing.

 

Customers are reminded that if they give or have given permission to have their personal data used for generic and profiled marketing by Max Mara Fashion Group S.r.l., the latter may process the personal data as described in the notice provided when signing up (available at the website it.maxandco.com/info/company-info/privacy-policy), including for sending marketing messages (e.g. newsletters, offers, event invitations, etc.). Serving as the Data Controller only with regard to the processing activity described above is Max Mara Fashion Group S.r.l. with registered office in Via Pietro Giannone, 10 - 10121 Turin - Italy. Dedimax S.r.l.
